There is a new law California passed this year and it affects every business owner in the country. If you do 25% or more of your business in California, you owe California state income taxes. If you already have a business in California, you can skip the rest of this email. You already are paying CA income taxes. This new California law has not been tested in courts outside of California. The US Supreme Court will probably have to be the final decider. But until that happens (and that could take years), here is how the law stands:If you have a worker in the state of California who performs more than 25% of the work for your company, you have California income. If you make sales or provide services to companies that are located in California and that represents more than 25% of your business, you have California income. The calculation I did this weekend was to determine how much of our revenue comes from California sales. Whew! We’re under the 25% threshold. I’m going to concentrate on marketing to businesses in the other states, though, for the rest of the year. The problem with falling under a foreign state’s jurisdiction is once you are there, it is very hard to leave. Tax Law Changes to Watch California’s far-reaching tax changes are just one of the state issues to watch for 2009. Sales tax is an even bigger item. If you have a business that sells only to local customers, you may have been impacted by changes and not even know it. On the July 25th call, I’m going to concentrate on changes in three areas: (1) Income Tax (2) State sales tax and income tax (3) Employment taxes We don’t have changes (yet) in employment taxes, but expect some big announcements here soon.
